Long <br />Wichita Falls, TX 76301 o~~i:~o" oi~ecr~r <br />Re: Oakridge Energy Inc., CDPS Permit COG-850027 DMR's and Pond Inspection Reports, Permit No. <br />C-92-080 <br />Dear Ms. Pautsky: <br />This letter is to confirm that the Division has received and has reviewed the quarterly sediment pond <br />inspection reports and the quarterly NPDES dischazge reports. The last time I sent a similar letter was for 2nd <br />quarter 1999, so this letter is for the period covering 3rd quarter 1999 to 4'" quarter 2000. <br />The Division has reviewed all of the Dept. of Health's NPDES discharge reports for outfalls 001 and 002 for <br />[he period stated above and with the exception of 4d' quarter 99 (which is missing) finds the NPDES reports <br />have been prepared in compliance with Rule 4.05.13(2)(a)(iii). During this entire report period, at no time did <br />the ponds discharge, therefore, no values exceeded the permit limitations and no problems were noted with <br />the reports. <br />The Division received Carbon Junction Mine's sediment pond inspection reports for the above mentioned <br />period (with the exception of 4'" quarter 99 and I" quarter 00) and although there were times that both ponds <br />had water in them, at no time did they ever discharge. According to the reports, both ponds are stable and <br />free of defects, aze functioning as designed, and have approximately 20% of [he pond's capacity filled with <br />sediment. Upon further review of past sediment pond reports, this same 20% figure for sediment has been <br />used since 1"quarter 1992. <br />Since it is unlikely that [he sediment level has not risen in the last nine years, the Division is concerned that <br />the ponds will no longer hold the designed flows. Therefore, please either have the ponds resurveyed and <br />submit the data to the Division, or have the ponds cleaned out to the original design levels. <br />Additionally, as mentioned in previous correspondence, according to Rule 4.05.9(13): <br />All impoundments shall be examined to assure appropriate maintenance of the structure and for structural <br />weakness, erosion and other hazardous conditions by a qualified registered professional engineer or a <br />qualified individual under their direction. The professional engineer or individual shall be experienced in <br />the construction of impoundments. The inspections shall be made regularly during construction, upon <br />completion of construction and, at a minimum, quarterly thereafter, with the report retained at or near the <br />mine site. A copy of the report shall be submitted to the Division on an annual basis by a registered <br />professional engineer. <br />
