BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE PETITION FOR HEARING BY ELBERT COUNTY, FILE <br />NO. M-1982-211 AND M-1985-129. <br />THIS MATTER came before the Mined Land Reclamation Boazd on March 26, <br />2003 at Denver, Colorado for hearing on a Petition for permission to sell gravel from <br />Elbert County. Tim Sheridan appeared on behalf of Petitioner Elbert County (Petitioner). <br />Bruce Humphries appeared on behalf of the Division of Minerals and Geology <br />(Division). The Board, having considered the Petition and Responses thereto, and the <br />azguments of the parties, and having been otherwise fully informed in the premises, <br />hereby finds and concludes that: <br />The Petitioner has two gravel pits in Elbert County known as the Thompson Pit <br />permits, and the Board has no authority to forbid or authorize the sale of construction <br />material. <br />THEREFORE, it is ordered that this matter is dismissed. <br />DATED this ~~ day of ~~~X. , 2003. <br />FOR THE COLORADO MINED LAND RECLAMATION BOARD <br />Hany Jav me Vice Chairman <br />
