Box 518 <br />Somerset, CO 81434 <br />Re: Succession_of Operation at the Somerset Mine, <br />-Bear Mine, C-81-033 <br />Dear Mr. Springer: <br />Please fill out this Succession of Operators form, should Bear Coal Company <br />choose to assume the rights and obligations of the Somerset property. Please <br />review Rule 2.08.6 of the Colorado Mined Land Reclamation Board for Coal <br />Mining Regulations. <br />I am also enclosing a sample Irrevocable Letter of Credit for use by your bank <br />in preparation of that document. In addition, there should be same statement <br />to the effect that the bank should notify both the principal (yourself) and <br />the Division in the event of bankruptcy and insolvency per item (f) of <br />"Additional Provisions" on the Coal Reclamation Bond form.
