L <br />'re re' <br />Roy Romer. <br />Governor <br />Michael B. Long, <br />Dn~sion Director <br />I would like to take this opportunity to briefly summarize our meeting of <br />March 10, 1992. Primarily, it was my intention to update you in regard as to <br />how the Division proposes to resolve a number of the GEC related issues. <br />The Division intends to reclaim GEC disturbances within Section 24. We are <br />estimating that it will take up to eight weeks to prepare the bid documents <br />such that a contract could be let. We will keep you informed as to our <br />progress in the contracting process. <br />The Division believes that a plain reading of the Harrison-Western bond <br />document indicates that Harrison is not responsible for reclamation of <br />Stockpile No. 2. This position also is supported by correspondence between <br />the Division and Harrison in 1985. We recognize that you disagree with this <br />assessment. <br />The Division believes that Harrison-Western is acting in the capacity of a <br />guarantor performing reclamation in~lieu of forfeiture. As such, they do not <br />need to obtain a permit. However, we do believe that Harrison is subject to <br />many regulatory requirements. These requirements include the specifications <br />of the reclamation plan and portions of Rules 2 and 4 applicable to <br />reclamation operations. These responsibilities will be clearly outlined in <br />the Compliance Schedule which we will negotiate with Harrison. I understand <br />that you may disagree with our interpretation of the permit requirement, <br />but that you may be more comfortable given their liability to the performance <br />standards as outlined in a Compliance Schedule. <br />You expressed concern regarding erosional stability of the West Pit, and the <br />handling of unaffected area water entering the disturbed area. These two <br />issues have been raised with Harrison-Western, and we hope to resolve them <br />during the Compliance Schedule negotiations. <br />
