This <br />project is located at wetlands adjacent to the Ana Branch, a side <br />channel of the Yampa River, within Section 6, Township 6 North, <br />Range 90 West, in the Town of Craig, Moffat County, Colorado. <br />We have received your letter and request for a Department of <br />the Army permit. In your letter, dated January 12, 2006, you <br />detail the numerous contacts we have had regarding this site <br />since 2003. We have visited the site on at least three <br />occasions, before and after your removal of irrigation water. <br />Each time we met and talked on the phone you were informed of <br />your options regarding the mining of this site, permitting <br />options, and requirements of a complete application. You were <br />also given a checklist for a complete application as well as a <br />wetland consultant list. You continue to insist that the Corps <br />of Engineers does not have jurisdiction over the wetlands on your <br />property because they were created by irrigation water. You have <br />yet to provide any definitive evidence that 100 percent of the <br />hydrology supplying water to the wetland was from irrigation, <br />which would make it a "man-induced wetland". The irrigation <br />influence has been removed for an entire growing season. Nathan <br />Green last visited the site on October 27, 2005, not normally a <br />wet time of year, and observed a large area of wetlands <br />remaining. You declined to have a wetland delineation performed <br />and verified by this office so it is difficult to tell if the <br />area of wetland has diminished since removing the irrigation <br />influence. You have provided a map showing where you think the <br />wetlands are located; however, this map does not meet the <br />Sacramento District Minimum Standards for Wetland Delineations <br />(which was included with the Wetland Consultant List), and has <br />not been verified by this office. <br />
