Division of Minerals and Geology <br />5731 State Highway-T3- - '-- - - - - - - - - <br />Meeker, Colorado 81641 <br />Re: Permission to Construct Ramp in West Pit in NW%4SW%, Sec. 4, T3N, R93W <br />Deaz Mr. Scott: <br />In response to your letter of May 27, 2003, we have reviewed your Company's plans for the <br />construction of a ramp near the west end of the West Pit. A small portion of this ramp, estimated <br />at less than 1.5 acres, will be situated on private land whose coal is reserved to the U.S. but is not <br />cunently under lease. This land is adjacent to Federal Coal Lease C-034365. We have <br />determined that there will be no mineable coal removed from this un-leased land as a result of <br />this construction and that neither a lease modification nor an R2P2 modification will be <br />necessary.
