Doc,' <br />Re: Rudy Fontanari / W"estern Slope Flags/toue Quarry No. 2 <br />Dear Mr. Means: <br />This letter will confirm our recent telephone conversation concerning the <br />above referenced matter. As I mentioned in our telephone conversation, we represent <br />Ute Water Conservancy District ("Ute Water"). Ute Water provides domestic water <br />to over 65,000 people in the Grand Valley. Ute Water's water treatment plant is <br />located in the Rapid Creek area northeast of Palisade, primarily in Lots 1 and 9 of <br />Section 2, T. 11 S., R. 98 W., 6"' P.M. <br />We understand that at least a portion of the Western Slope Flagstone Quarry <br />No. 2 proposed by Mr. Fontanari will be located near or adjacent to Ute Water's <br />treatment plant property. Ute Water desires to ensure that if mining activities are <br />allowed to be conducted in the vicinity of its treatment plant, such activities do not <br />cause damage to its treatment plant. <br />We understand from you that Mr. Fontanari has not yet filed an application <br />for a mining permit with the Colorado Division of Minerals & Geology. We hereby <br />request that if an application for a mining permit is filed by Mr. Fontanari to allow <br />him to conduct mining activities in the vicinity of Ute Water's treatment plant, Ute <br />Water be given notice of the filing of that Application.
