It is Division policy, and Colorado law <br />pursuant to the Colorado Open Records Act, to supply all documentation related to a permit, with the <br />exception of confidential materials, to the public upon request. <br />The objectors' representative received four CDs of imaged documents ofthis file on Apri126, 2006; May <br />1, 2006; May 17, 2006; and May 23, 2006. The last correspondence related to permit adequacy issues <br />was imaged into the system on May 10, 2006. Therefore, the electronic file was current as of that date. <br />According to the objectors' representative, the CDs provided on Apri122, May 1 and May 17 were <br />incomplete. The Division was notified by the objectors' attorney of the missing documents in these CDs <br />on May 22 and 23' and immediately faxed the materials to the attorney. <br />Pursuant to Division procedure, the CD produced on May 17, 2006 should have been current and <br />complete. Therefore, the Division is investigating the allegation that the CDs were incomplete, and is <br />attempting to obtain copies of these CDs to determine which documents may have been missing.
