With <br />this letter Peabody is re-activating the Seneca II-W <br />Permit. Construction activity on the tie-across haul road <br />is scheduled to commence on or about April 24, 1989 in <br />conformance with the approved permit. <br />Peabody understands that disturbance within the mine <br />permit area must be preceded by resolution of Stipulations <br />6, 11, and 12. Also, prior to blasting within the mine <br />permit area, Stipulation No. 9 must be addressed. <br />Therefore, at this time, construction activity will be <br />limited to the tie-across haul road. <br />Sincerely, <br />James S.
