Long <br />Drviaion Dneaor <br />(landowner above MCC <br />I received a phone call today from Elaine Mautz who is a landowner <br />above the West Elk Mine, operated by Mountain Coal Company. She <br />told me that the road in Lone Pine Gulch has been made impassable <br />by MCC's mining. She said that about 200-300 yards past the fan is <br />where the road begins to deteriorate. She said that the road is <br />sliding. She said there are no cracks on the road. She said that <br />she understands that it is a wetter year, but they experienced some <br />subsidence and problems last year when it was drier. She also MCC <br />has a dozer stuck in the road. She said that MCC is refusing to <br />repair the road because they say it is not due to their mining but <br />to the increase in precipitation. She did say that at one point <br />MCC had agreed to repair the road and did start but did not finish. <br />She said they (Mautz's) are willing to repair it, but would charge <br />MCC because they are working on other projects and would be <br />inconvenienced. She wants them to at least fix the road so its <br />passable. She mentioned installing culverts, ditches, etc. <br />In addition, she said that the cabin in Lone Pine has received some <br />damage. There are cracks in the walls and/or foundation due to one <br />side settling more than the other. She said MCC has agreed to fix <br />the cabin by September 17, 1995. Mrs. Mautz said she had told them <br />September 6, 1995. She said that MCC is supposed to be getting <br />bids today to repair the cabin. <br />I told her that I would be there next week and would call her <br />Monday if she was interested in going up there with me.
