Generally, we believe that actual postmining contours <br />are a fairly good aDProximation of planned postmining contours (albeit more <br />diverse). Therefore, the final Postmining vegetation community should have a <br />better chance of achieving greater diversity and thus being able to meet the <br />approved success standards. <br />The only concern that arose from the review is in regard to the apparent spoil <br />buildup at the bottom of the Wadge Pit. We are sure that Peabody is aware of <br />Rules 4.14.1(2) and 4.14.2 which generally require that all overburden <br />material removed from mined areas be returned to those areas unless it is <br />demonstrated that final volume of spoil is greater than 1.2 times the volume <br />of the mine pit (Rule 4.14.5). With this in mind, the Division is requesting <br />that Peabody submit a technical revision to the permit that addresses the <br />following: <br />1. The material balance for the Wadge coal mining area, <br />2. A plan for spoil handling which states where the spoil between the bottom <br />of the Wadge mining area and above Sediment Pond 008 will go, <br />3. Bond recalculations that address any changes in spoil handling brought <br />about by 1 and 2 above. <br />The technical revision must be submitted within 120 days of this letter. <br />If you have any questions, please contact me. <br />Sincerely, <br />L/~/1~~~ p-~ <br />Carl B.
