Cattany <br />RE: Roadside North and South Portals Mine Acting Division Director <br />Perini[ C-1981-041 <br />Inquiry Regazding South Portal Facilities <br />Deaz Mr. Fontanari: <br />In our phone conversation on July 1, you expressed your possible interest in acquisition and future use of <br />certain of;'ice/shop/wazehouse buildings at Snowcap Coal Company's South Portal facility azea. As we <br />discussed, the approved post mining land use is wildlife habitat, and the currently permitted reclamation <br />plan for the South Portal Area requires demolition of all surface strnctures,highwall elimination, regrading <br />[o approved (approximate original) contours, topdressing and revegetation. This work is to be completed <br />by 2004. Modification of the current permit requirements and tnneframes, as would be necessary to <br />accommodate an alternative post mining land use of industriaVcommercial for designated portions of the <br />permit area, would requve approval of a post mining land use peratit revision. The revision wouldlikely <br />need to include demonstrations to allow for regulatory variances from approximate original contour and <br />highwall elimination requirements of the regulations. <br />I have enclosed various sections of the Coal Regulations that apply to alternative land use demonstrations <br />and vaziances from highwall elimination and restoration of approximate original contour requirements. <br />• Section 1.04(71) Land Use Definitions. <br />• Section 2.06.$ Variances from Approximate Original Contour (AOC) for Steep Slope Mining. <br />• Section 4.14.1(2) Method for backfilling and grading (exemptions that may be applicable aze listed in <br />Rules 4.14.1(2)(e), 4.14.1(2)(fJ, 4.14.1(2)(g), 4.27.4, and 2.06.$. <br />• Section 4.1$.10(2) Revegetation requirement for areas to be developed for industrial or commercial, or <br />residential use less than 2 years after approval of such use. <br />• Section 4.16.3 Alternative Land Uses. <br />• Section 4.27.4 Limited Variances for steep slope coal mining <br />I hope this information is helpful to you.
