This poses a problem regarding periodic CMLRD inspections of <br />the mine site. CMLRD regulations paragraph 5.03.3(2), Right of Entry, states <br />in part: <br />"Any authorized representative of the Division, upon presentation <br />of appropriate credentials, shall have the power to enter at reasonable <br />times, ..." <br />Snowmass submits that an authorized representative must have someone to present <br />credentials to before the representative may enter the mine site. <br />An additional problem exists if the Division's representative enters the site <br />while not accompanied by the operator's representative. The Division then <br />assumes what must be an uncomfortable position regarding potential accusations <br />of theft or vandalism, especially if the representative circumvents locked <br />gates. <br />Snowmass proposes a rather simple solution to both problems. If the Division <br />will call our Palisade office 24-hours prior to an inspection, Snowmass will <br />arrange for an operator's representative to meet with the Division's representative <br />to check credentials and accompany the representatives on the mine site tour. <br />
