Hautz: <br />SEP 2 7 !~3 <br />This letter ie in response to your letter of July 27, 1993, which was <br />delivered to this office by Hrs. Hautz on September 16, 1993. It is <br />unfortunate that you were not happy with the exploration work that was <br />completed. At this time, the only thing that can be done is to reclaim the <br />road. Once the road is reclaimed, your concerns will be mitigated. <br />Fortunately, you are the surface owner and contractor for completing the <br />reclamation. We are confident the road and drill sites on your lands will be <br />reclaimed to your satisfaction as set forth in your agreement with Mountain <br />Coal Company (HCC). <br />In response to your question about filing a claim against the reclamation <br />bond, that ie not possible. The bond that HLH holds is for reclamation of the <br />drill sites. Aa we stated in our letter to you dated June 21, 1993, the <br />current reclamation bond is sufficient to cover damages if Mountain Coal <br />Company ie negligent in reclaiming their exploration roads and drill pads. If <br />it waa determined that MCC was negligent, the BLH would use the bond to <br />contract services to complete the reclamation work. There is no provision in <br />the regulations that provides for another party to file against the <br />reclamation bond.
