That <br />plan was initiated and approved prior [o the enactment of the Surface <br />;;fining Control and h;eclamation Act of 1977, P.L. 95-87 (30 U.S.C. ® 1201 <br />et. seq.). <br />The Surface }iining Act and its attendant regulations have establisi~ed new <br />standards for operation such as yours. As a result of the Act and the <br />August 22, 1978, amendr.,ents to 30 CFR Part 211, operations which <br />constitute "surface coal mining operations" as defined in Section 701(28) <br />of [he Surface dining Act are subject to the mining plan review and <br />approval requirements of 30 CFR Part 211 and 30 CFE Partp~7,4`1_. <br />",! <br />F.ach of your test sites appr in Novem r of 1976 involves five <br />entries on 80-foot cent s. Test Sites and 3 have not been started, ~(,lc Cl"`e <br />and Test Site No.`~ as been idle since November 1978. Test Site No. 1,~ <br />however, has been mined to 1380 feet and is still in operation. <br />Approximately 160,000 tons of coal have been mined to date. It is our <br />determination that this operation exceeds exploration needs and <br />constitutes "surface coal mining operations." The referenced prospecting <br />plan is therefore no longer valid authority for the continued conduct of <br />your operation. <br />The entire active operation and affected lands became subject to <br />30 CEP. 211 on September 22, 1978, and 30 CFR 741 on April 12, 1979, as a <br />"surface coal mining operation." Said regulations require approval of a <br />mining plan and permit prior to the conduct of "surface coal mining <br />operations."
