In <br />response to a previous request to MSHA dated February 10, 1992, Cyprus Orcl~ani <br />Valley had obtained prior approval to utilize the shafts for the disposal of <br />materials normally put into the refuse disposal area. The materials identified <br />for disposal in the shafts included rock, coal waste, rock dust, aryl contaminated <br />coal. MSHA aclQ~owledged this request aryl concurred that the rem>; rP~++Ants 30CFR <br />75.1711-1 would be met under this scenario given the previous partial backfilling <br />of the shafts with incanhu_stible materials as required by the regulation. <br />As of March 15, 1994, the uppermost approximately 15 to 20 feet of both the <br />intake and e~draust shafts remained available for the disposal of refuse <br />material. Sediment pond cleanings from the west Ridge Waste Pile Pond and <br />Sediment Pond #2 were deposited in the shafts to within approximately 1 to 2 feet <br />of the collar elevations. SUlstantial barricades were erected at the shaft <br />mouths during and following these operations and other appropriate precautions <br />were utilized to ensure the safety aspects of this operation. <br />If you have any questions or cormrents, please contact me at 303-527-4135.
