r ~ III IIIIIIIIIIIIIIII
DEPARTMENT OF NATURALAESOURCES
David H. Getcnes. Executive Director
MINED LAND RECLAMATION DIVISION
DAVID C. SHELTON, Dlreetor
Richard D. Lamm
Governor
November 8, 1985
To: File:
From: Jeff
Re: WFC STIPULATION RESPONSES, NEW ELK MINE - FILE N0. C-012-81
Stipulation No. 16:
WITHIN 12 MONTHS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT TO THE
DIVISION FOR APPROVAL, A DETAILED PLAN DEMONSTRATING HOW THE ESSENTIAL
HYDROLOGIC FUNCTIONS OF THE ALLUVIAL VALLEY FLOOR IN THE AREA DISTURBED BY
SURFACE OPERATIONS WILL BE PRESERVED OR RESTORED. THE ESSENTIAL HYDROLOGIC
FUNCTIONS OF THE DISTURBED ALLUVIAL VALLEY FLOOR MUST BE PRESERVED OR RESTORED
• TO A CONDITION SIMILAR TO THAT OF REPRESENTATIVE ADJACENT UNDISTURBED ALLUVIAL
VALLEY FLOORS IN THE STONEWALL VALLEY. THIS PLAN WILL BE SUBMITTED AS A
REVISION TO THE PERMIT.
To date the response to this stipulation has been "Map 15 of the New Elk
Permit Application indicates the potential for flood irrigation". In fact,
this map shows that the post-mining grade varies from 2-10-%. The local SCS
says flood irrigated land in the region is approximately 2-3% slope. The
approved PMLU tails for irrigated crop land on virtuaily all of the disturbed
area south of the Purgatoire, and some of the area north of the Purgatoire.
WFC is currently proposing grass land for these areas. Two questions arise
from this:
1) Should we require more detailed contouring plans to verify
flood-irrigability;
2) Is the planting of grass land in compliance with the approved PMLU. There
has been a change in seed mix proposed.
Stipulation No. 18:
WITHIN 12 MONTHS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT THE RESULTS OF
THE ANALYSIS OF A GRAB SAMPLE FROM THE TOPSOIL STOCKPILE NEAR THE DEVELOPMENT
WASTE DISPOSAL PILE. IN ADDITION, THE PERMIT APPLICATION MUST BE UPDATED TO
INCLUDE THIS INFORMATION.
• A grab sample of the topsoil stockpile has been submitted along with other
soil samples taken to fulfill Stipulation 19. The material is very sandy,
high in pH, and may have coal refuse material mixed with it.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. (303) 866-3567
