Sunland Plining Corporation ("operator") desires to conduct a <br />mining operation known as Apex No. 2 Mine <br />for the purpose or extracting coal. <br />II. Dn May 26 19 83, the rlined Land Reclamation Division ("the <br />Uivision" approved operator's application for this permit, fixed the amount <br />of bond and sirected that this permit be issued upon the filing with the <br />Division of bond in the amount so fixed in form and substance approved oy the <br />Division, and such bond has been so furnished. <br />III. Dn April 14 19 g3, the Division made the following findings: <br />a) The pernit appllCatlOn is accurate and contains all information <br />required under C.R.S. 1973, 34-33-101 et seq. and regulations prornulyaied <br />thereunder and that all the requirements or Articla 33 of Title 34, C.R.S. <br />1973 ("such article"j for the issue of a permit have been complied with; <br />o) The applicant has demonstrated that reclamation as required by such <br />article can be accomplishes under the reclamation plan contained in the permit <br />application; <br />c) Tite assessment of the probabl=_ cumulative impact of all anticipated <br />gaining in the area on the hydrologic balance specifies in Section <br />3~-33-11uI2) ;l) nas been mace by the Uivision ans the proposed operation <br />tnereof has been designed to prevent material damage to hydrologic balance <br />dutsise the permit area; <br />d) Grantii~y the permit will not conflict with any designation decision <br />issuea pursuant to Section ~22 of the f=ederal "Surface rlininy Control and <br />Reclamation Act of 1917", as amended, (P.
