Situations arise at the <br />Deaerado Mine where infrequent blasting ie needed on the surface. A specific <br />example during winter operation is when the coal surge bin freezes and must be <br />blasted out. In theee cases, a small charge (approximately two pounds) is used to <br />dislodge the coal. Since this is an unforseen operational occurence, it must be <br />bleated immediately; thus eliminating any possibility of public notice. <br />I have studied Section 4.08 "Use of Explosives". The regulations state that <br />blasts using more than five pounds of explosives shall be conducted according to a <br />published schedule. Our interpretation of the rags ie that no public notification <br />ie required if the bleat uses five pounds or less of explosives. <br />Therefore, we will not notify your office or the public when bleating with five <br />pounds or lees. We will however meet the other requirements of Section 4.08 such <br />ae using experienced, trained, and competent personnel who possess valid certifi- <br />cation in accordance with Federal and State law, bleating only during daylight <br />hours, using warning signals, and controlling access to a blast area. if you have <br />questions regarding surface blasting at the Deserado Mine, please contact me. <br />Very truly yours, <br />-gin--~ ~ ~~~ <br />Tommy D.
