Box 1821 Colorado Springs, CO 80901 RE: Citizen's Request for Inspection GEC Minerals, The GEC Strip Mine Revoked Permit No. C-81-037 Dear Dr. Corley: On January 19, 1993, the Division received a request Strip Mine per Rule 5.02.5 of the Regulations of the Reclamation Board for Coal Mining. Long Division Director GEC to The Division has elected to postpone its inspection of the hydraulic calculations for the 30" culvert. This is the culvert installed by Harrison Western Corporation in the West Pit pond at the GEC Strip Mine. The reason for the postponement of the inspection is that the Division is currently involved in negotiations with Harrison Western regarding the culvert and other related issues. We believe that should these negotiations conclude favorably, any concerns regarding the culvert may be resolved in so much as the culvert may be removed per your wishes. The Corley Company has been previously contacted regarding this pending settlement in order to resolve this and other concerns. We also believe that as it appears that no imminent harm or damage currently exists, the issue does not require an immediate resolution. We hope to conclude our negotiations with Harrison Western prior to the February 24-25, 1993 Mined Land Reclamation Board Meeting. We will notify The Corley Company of the results of the negotiations immediately following their conclusion. Should the negotiations not conclude in accordance with the Division's dishes, the Division will proceed with responding to The Corley Company's request. The Division will issue a response to your request for an inspection by March 5, 1993.
