Box 1821 <br />Colorado Springs, CO 80901 <br />RE: Citizen's Request for Inspection <br />GEC Minerals, The GEC Strip Mine <br />Revoked Permit No. C-81-037 <br />Dear Dr. Corley: <br />On January 19, 1993, the Division received a request <br />Strip Mine per Rule 5.02.5 of the Regulations of the <br />Reclamation Board for Coal Mining. Long <br />Division Director <br />GEC <br />to <br />The Division has elected to postpone its inspection of the hydraulic <br />calculations for the 30" culvert. This is the culvert installed by Harrison <br />Western Corporation in the West Pit pond at the GEC Strip Mine. The reason <br />for the postponement of the inspection is that the Division is currently <br />involved in negotiations with Harrison Western regarding the culvert and other <br />related issues. We believe that should these negotiations conclude favorably, <br />any concerns regarding the culvert may be resolved in so much as the culvert <br />may be removed per your wishes. The Corley Company has been previously <br />contacted regarding this pending settlement in order to resolve this and other <br />concerns. We also believe that as it appears that no imminent harm or damage <br />currently exists, the issue does not require an immediate resolution. <br />We hope to conclude our negotiations with Harrison Western prior to the <br />February 24-25, 1993 Mined Land Reclamation Board Meeting. We will notify The <br />Corley Company of the results of the negotiations immediately following their <br />conclusion. Should the negotiations not conclude in accordance with the <br />Division's dishes, the Division will proceed with responding to The Corley <br />Company's request. The Division will issue a response to your request for an <br />inspection by March 5, 1993. <br />
