The North Decline area is located in N'/~ NE'/< Section 34 and NW'/< <br />NW'/a Section 35, Township 10 South, Range 98 W, of the 6th Prime Meridian and comprises <br />18.3 acres. The North Decline area is adjacent to 1-70 and is highly visible from the <br />highway. <br />A short history on this location indicates that portions of the permit area have been mined <br />since the 1890's. The North Decline area was disturbed prior to the enactment of the <br />permanent regulatory coal program. Portal construction at the North Decline was initiated <br />in the early 1970's. Use of the portal was discontinued and sealing of the portal occurred <br />in 1990. Since this area was disturbed "pre-law" no topsoil was salvaged. <br />The operator had been approved in the permit to reclaim the North Decline area with a <br />variance to approximate original contour. Excavated material from the portal decline had <br />been approved to remain in a "U" shaped 30 ft. tall hill encircling the backfilled portal. <br />(Permit Maps 12B and 12C) A reclaimed drainage that crossed the site from upland <br />undisturbed area to a highway culvert running under I-70 had been designed to contain an <br />abrupt 90° turn. <br />In early March 1992 the operator submitted a revision to modify the final regraded contours <br />to more closely align with approximate original contours and blend more readily with the <br />surrounding undisturbed landscape. This revision was approved by the Division as TR-13. <br />The revision also proposed realignment of the channel with a general sinuosity and <br />eliminated the abrupt 90° turn. These modified contours required considerably more <br />earthmoving work to be performed by the operator. <br />Initial earthmoving at the North Decline commenced in March 1992. Care was taken during <br />the reclamation work to salvage existing shrubs in the northern part of the site where <br />
