Begej
Mined Land Reclamation Div.
1313 Sherman St.
Denver, CO 80203
Dear Ms. Begej:
~~~~i~ „ ,
~~
SAY 2219g<
Recl m°eo C^~a,
~7
We have had a delay in answering your letters since we were out of town when
your letters arrived last week.
Harrison Western converted the ditch into a road when they constructed the
rock check dams and excavated the sediment pond in 1990. At that time we
observed the newly created road. The work was done with a track-type loader,
probably a 943. We think that you may have aerial photos of the West Pit
prior to and after 1990 that will confirm that Harrison Western did create the
road. Harrison Western was the only entity that performed any work in the
area from 1987 to the present. We will review our photo files for other
pictures; we think that we have pictures of that area before 1990.
We also believe that Mr. Neslin testified at the April Board meeting while
viewing an overhead copy of the exhibit A map attached to the bond that
Harrison Gle.stern planned to use the northerly narrow area of the West Pit as
an access road, that Harrison Western did drill a hole [pointing to the
existing drill hole area] and that they planned to use the southwest area as a
staging area. A review of the audio tape should confirm our memory.
SJe will wait for your review. We appreciate the Division's approach to these
matters and agree to your proceeding according to Rule 5.02.5(4).
Sincerely,
W.D. Corley, J
f ~~
President
