Dear Mr. Sullivan:
Attached is the Division's Mid-Term Review and Decision to require revisions
to the Hayden Gulch Mine, Permit No. C-003-80. The review was in fulfillment
of Rules 2.08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5), and 3.02.2(4).
The mid-term review primarily consisted of reviewing the permit application,
stipulation responses, revisions, and any supplemental information, as well as
information from field inspections and past inspection reports. The main
purpose of the review was to identify any areas of the permit application that
will need to be revised or modified to ensure compliance and reflect the
current status of the mine.
The attached document contains our mid-term review, a rationale for requiring
any revisions to the application, timetables for submitting responses, a
summary of the status of stipulations, and the results of our performance bond
review.
Revisions were found to be needed under the categories of In general, most
of the items pose no immediate ehvironmental concerns, rather they serve to
make the mine plan more clear and concise and answer stipulations. Many of
the items needing revision are activities that have been approved in response
to original permit stipulations which need to be incorporated and consolidated
into the application. Examples are the revisions that have been made to the
revegetation success criteria for the mine and the additional topsoil
stockpiles. A few items such as the Legal, Financial, and Compliance section
will need to be updated to reflect changes since the permit was first issued.
