The Division reviewed your letter regarding topsoil calculations submitted by <br />Pathfinder Development, Inc. <br />Our records indicate that the topsoil inventory was not included in Technical Revision No. 3 (7R- <br />003) though it was submitted during the same time period that TR-003 was being reviewed. TR- <br />003 did, however, address the location of the temporary topsoil stockpiles. <br />DMG reviewed Pathfinder's topsoil figures when they were submitted by the operator and <br />discovered the same miscalculations identified in your letter. When the Division corrected the <br />miscalculations in Pathfinder's submittal, the result was a net increase in the amount. of available <br />topsoil for reclamation. In addition, our own independent calculation resulted in a net surplus in <br />the calculated amount of topsoil resources available on site to reclaim the affected area with the <br />required 6 inches of topsoil (7,461 c.y.l• We therefore do not consider the adequacy of topsoil <br />for reclamation or the miscalculations identified in your letter to be an issue requiring further <br />attention at this time. We will, however, continue to monitor the site during our inspections to <br />ensure that the site remains in compliance with their approved permit and the Act and <br />Regulations. <br />If you have additional questions, please contact Steve Shuey at the Division's Durango Field <br />Office. <br />R/espectfully, '~',/J / j <br />H.
