Cattarry <br />Division Director <br />`// Natural Resource Trustee <br />Re: Notice of Formal Public Hearing; Request for Motion to Intervene by the Energy Minerals Law <br />Center on the Appeal ofThe Division of Minerals and Geology D~ eft +'~'~ination of Designated Mining <br />Operation Status for M-1977-306, JD-9 Mine, M-1977-310, JD-GMine and M-1984-OI4, JD-8 Mine. <br />On June 14a', 2006 The Colorado Mined Land Reclamation Board granted a request to hear the motion <br />to intervene by the Energy Minerals Law Center at the August Board hearing. The request is in <br />reference to a Notice of Appeal of the Division of Minerals and Geology's March 9th determination that <br />the above referenced mines meet the criteria of a Designated Mining Operation per Rule 7.2. <br />Therefore, Division staff has scheduled the matter for Formal Public Hearing before the Colorado Mined <br />Land Reclamation Board, for consideration. The hearine will be held in Room 318. 1313 Sherman <br />Street, Denver, Colorado, on August 16`h~17, 2006 commencing at 9:00 a.m. or as soon thereafter as the <br />matter can be considered. Please note this hearing is to establish whether to allow the intervention and <br />party status of Energy Minerals Law Center. The merit of the appeal and related issues under <br />consideration are sepazate from this proceeding. If the Boazd decides to hear the Appeal, the Board will <br />set the date for full consideration at a future Board Hearing.
