Colowyo <br />intends to mine several coal seams including the X and A seams from the proposed South Taylor pit. <br />These two coal seams run through the upper fraction of an unnamed mountain dividing the Taylor <br />Creek, Wilson Creek, and Good Spring Creek drainages. The entirety of the X and A seams will be <br />removed from the top of the anticline within the mountain except for the portion of the A seam that <br />extends beneath the Section 16 pit and adjacent area. Removal of the X and A seams appears to meet <br />the definition of mountaintop removal stated in sections 2.06.3 and 4.26 of the CDMG coal mining <br />regulations (2 CCR 407-2). <br />Colowyo proposes to treat the South Taylor pit as "Mountaintop Removal" for the purposes of post- <br />mining topography. Post-mining topography will result in a grade that is at or above the elevation of <br />the base of the A Seam and is at a slope of ]v:5h or less; where remaining slopes to the edge of mining <br />impact are at a slope of lv:2h or less; and wherein the drainages will maintain a water balance in the <br />watersheds. All other requirements of the regulations will be met. <br />Walsh requests that the CDMG provide a determination if they concur with the application of <br />"mountaintop" removal for the South Taylor pit as soon as practical. A figure showing the proposed <br />pit, steep slopes, and X and A seams is included.
