Box 880 <br />Trinidad, Colorado 81082 <br />Dear Mr. Cordova: <br />The Division has reviewed your Letter of October 5, 1990 regarding the <br />proposed Rimrock Coal Company's disposal of non-coal waste. <br />The Rimrock Coal Company stated in the surface coal mining and reclamation <br />permit application that the city landfill would be used to dispose of all <br />non-coal waste (Permit Application Volume No. 1 page 2.05.4(2)(f)). The <br />Division accepted this plan as being in accordance with the regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining, Rule 4.11.4(2). <br />It is the understanding of the Division that the operator mast obtain the <br />necessary permits to dispose of any non-coal waste generated at the mine <br />in an approved disposal area outside the permit area. <br />If the operator does not acquire the proper permit to dispose of the waste in <br />the city land fill the Division will require Rimrock Coal Company to revise <br />the permit to include non-coal disposal in the permit area in accordance with <br />Rule 4.11.4(1 ). <br />At this time the Division has issued a proposed decision and findings of <br />compliance for the permit. However, Trend In Colorado, an environmental group <br />opposing the permit has requested a hearing before the Colorado Mined Land <br />Reclamation Board to present their opposition to issuance of the permit. The <br />Division has scheduled a formal public hearing before the Board, to be held on <br />November 14 or 15, 1990. You will be notified of the exact date once the <br />Board's Agenda has been finalized. <br />
