~ III IIIIIIIIIIIIIIII ~J
STATE OF COLORADO
Roy Romer, Governor
DEPARTMENT OF NATURAL RESOURCES
MINED LAND RECLAMATION DIVISION
DAVID C. SNELTON, Director
February 23, 1987
Mr. Jack R. Starner
President
Delta Sand and Gravel Co.
P. O. Box 103
Delta, Colorado 81416
Re: Delta Sand and Gravel Co. - "Pit No. 3" - File No. M-77-022
Dear Mr. Starner:
Our Division has received your report of February 16, 1987 stating that your
mining operation captioned above is no longer active. A receipt for your
annual fee and report for this pit and for File No, M-77-020 is enclosed.
Please be advised that Rule 1,6 of the Rules and Regulations for Minerals has
recently been revised by the Mined Land Reclamation Board to more clearly
delineate the duties of an operator whose mining operation is in a state of
temporary inactivity. A copy of this new Pule is enclosed.
Please review this Rule carefully and notify our Division concerning the
status of your operation. If the operation is in temporary cessation, please
submit a Notice of Temporary Cessation that complies with the requirements of
Rule 1.62. The start of the five-year temporary cessation period should be
specified in the Notice and should be the date on which the mining operation
ceased. If, on the other hand, the mining operation should not be considered
to be in temporary cessation, please outline the reasons that this operation
should still be considered to be active.
Failure to file a proper Notice of Temporary Cessation can result in a
violation to your permit being found by the Mined Land Reclamation Board, or
even termination of your life-of-the-mine permit for this operation. Please
respond to this letter within 30 days to avoid further Division action on this
matter.
If you have any questions, please contact me.
Sincerely,
G~r~~ ' 0
Mark S.
