Lochhead <br />Ezeculrve Director <br />Michael B~ Long <br />Dwision Drtector <br />This letter serves as a reminder to Mountain Coal Company (MCC) <br />that with the recent construction of the cabin by Larry and Elaine <br />Mautz in an area to be undermined, the permit must be updated with <br />the required information in Rule 2.05.6(6), Subsidence Survey, <br />Subsidence Monitoring, and Subsidence Control Plan. The Division <br />became aware of the cabin at the end <br />inspection. At that time the Division <br />above rule and perform a pre-subsidence <br />dated September 27, 1994). To date, the <br />the results of the pre-subsidence survey <br />by 2.05.6(6). Zn addition, a determination must be <br />made as to whether subsidence, if it occurred, could cause <br />material damage or diminution of reasonable use of the <br />structure. <br />*If it is determined that no material damage will occur, and <br />the Division concurs, a monitoring program should be designed <br />to determine the accuracy of that conclusion (Rule <br />2.05.6(6)(b)(ii). <br />*If material damage could result in the event of mine <br />subsidence within the permit area, then a subsidence survey or <br />a subsidence control plan should be prepared (Rule <br />2.05.6(6)(b)(iii). <br />III IIIIIIIIIIIII III <br />STATE OF COLUI 9~llU <br />
