This letter serves as a reminder to Mountain Coal Company (MCC)
that with the recent construction of the cabin by Larry and Elaine
Mautz in an area to be undermined, the permit must be updated with
the required information in Rule 2.05.6(6), Subsidence Survey,
Subsidence Monitoring, and Subsidence Control Plan. The Division
became aware of the cabin at the end

made as to whether subsidence, if it occurred, could cause
material damage or diminution of reasonable use of the
structure.
*If it is determined that no material damage will occur, and
the Division concurs, a monitoring program should be designed
to determine the accuracy of that conclusion (Rule
2.05.6(6)(b)(ii).
*If material damage could result in the event of mine
subsidence within the permit area, then a subsidence survey or
a subsidence control plan should be prepared (Rule
2.05.6(6)(b)(iii).
