Banta, Director <br />Mined Land Declamation Division <br />Department of Natural Resources <br />State of Colorado <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203-2273 <br />RECEIVED <br />JUL 71988 <br />MINEQ LAND <br />RECLAMATION 1~IVI$IOW <br />July 5, 1989 <br />RE: KC-81-016 - Hawk's Nest Mine owned by Western Slope <br />Carbon, Inc., a Colorado corporation <br />Dear Mr. Banta: <br />You may recall that the undersigned from this office <br />appeared in Denver on two occasions on behalf of the Western Slope <br />Carbon, Inc., in connection with the renewal of its permit and in <br />connection with your order of compliance with certain reclamation <br />projects at the mine site. <br />The permittee, Western Slope Carbon, Inc., failed to <br />comply with your requirements and failed to obtain a renewal of its <br />permit and your agency thereupon revoked on about June 1, 1989, its <br />security bond, which we believe was in the form of certificates of <br />deposit or similar good money which you may now have converted into <br />cash tc u=_e and be held for purpose of completing the required <br />reclamation work. <br />it is our understanding that if there are any funds <br />remaining after completion of your work, they will be returned to <br />the permittee and principal on the bond, Western Slope Carbon, Inc. <br />We are sorry that they were not able to comply and also <br />sorry that they failed and refused to pay our attorney fees and <br />expenses and we therefore have obtained a money judgment against <br />Western Slope Carbon, Inc., in the County Court of Delta County, <br />Colorado, for approximately $1,400.00. We believe that the <br />proceeds, if any remain after payment for the reclamation work, is <br />the only asset available to the corporation, since the mine <br />property itself is not readily saleable and we would have no <br />purpose or benefit in attempting to levy upon this property by an <br />execution under our judgment. <br />
