Dept. of Naiurai ;u;;;;.. , ._ Please be advised that this office represents the Board of County Commissioners of Weld County with respect to the Hokestra Pit, your file number 80-14. This letter is in response to a telephone call of June 14, 1983, from Linda Walker regarding a "discussion" to be held regarding the Hokestra Pit at the June 22, 1983, Mined Land Reclamation Board hearing. I was informed that, at the request of the Slovek family, the Hokestra Pit was to be placed on the agenda for the meeting of the Mined Land Reclamation Board, but that the staff did not have any knowledge as to the actual substance of the proceedings. I was further advised that the staff had no complaints as to any existing violations at the Hokestra Pit. I was also asked if appearing at the June 22 meeting would allow me adequate time in which to prepare for the meeting, but the staff was unable to provide any information as to what I should be preparing for. tds. Walker did indicate that she thought the Sloveks would likely wish to discuss damage that they claim was caused by our opera- tion to their property and to their banks along the St. Vrain Creek. Because this matter is currently on appeal to the Court of Appeals, 83-CA-0005, from Weld District Court, Case No. 81-CV-520, and the Board or staff has no particular issues to discuss, I respectfully decline your invitation to discuss the matter before the Board with the Sloveks. However, the County will respond to any parti- cular concerns the Board or staff may have i_n an appropriate fashion.
