Long <br />Division Director <br />Dear Ms. Thomas: <br />The Division of Minerals and Geology (Division) received your letter of February 6, <br />2002. The Division attempts to notify the Western Slope Environmental Resource <br />Council (WSERC) of revisions that are submitted by Mountain Coal Company and <br />Oxbow Mining LLC. We are in the process of changing some of our internal procedures <br />and WSERC was inadvertently left off the notification list. I would like to add that when <br />the Division calls a Technical Revision, Permit Revision or Permit Renewal application <br />complete, a notice is published in a local paper as required by Rule 2.07, Public <br />Participation and Approval of Permit Applications. The notice sets forth the public <br />comment period and where a copy of the submittal is available for the public to review. <br />A list of outstanding revisions for the West Elk and Sanbom/Elk Creek Mines is attached. <br />In your letter you also asked about the process by which members are appointed to the <br />Mined Land Reclamation Boazd (Board). The Board consists of seven members. Five <br />members are appointed by the Governor with confirmation from the Senate as follows: <br />two with substantial experience in the mining industry, two with substantial experience in <br />conservation and environmental resources, and one with substantial experience in <br />agriculture. The remaining two seats are filled by the Executive Director of the <br />Department of Natural Resources (or the executive director's appointee) and a member of <br />the State Soil Conservation Board.
