Box 229 <br />Boulder, Colorado 80306 <br />RE: Division Review of Responses to Stipulations for the Bourg Strip Permit <br />No. C-021-81 <br />Dear Ms. James: <br />This letter will serve as a review of the responses suomitted by Walden Coal <br />for Stipulations 1 through 6 to the original Bourg permit and for Stipulations <br />1 and 2 for the Technical Revision No. 1 (incorporating the Northgate <br />Load-out) to the Bourg Strip permit. <br />Stipulation No. 1 required that Walden Coal Company provide a map and <br />discussion delineating those areas in which oxidized coal has been or will be <br />disposed and explain the method of disposal. Walden Coal nas inet the <br />requirements of this stipulation by providing this discussion and delineating <br />the areas. The requirements of this stipulation were satisfied in March of <br />1983. <br />Stipulation No. 2 required the permittee to demonstrate the suitability of <br />soil material to the north of the office and shop area. Walden Coal submitted <br />this information and satisfied the stipulation in April 1983. <br />Stipulation No. 3 required the permittee to provide the Division with adequate <br />baseline woody plant density information for the grassland vegetation type. <br />This stipulation also required the permittee to develop woody plant density <br />revegetation success criteria and have these approved by the Division prior to <br />being relieved of the obligations of the stipulation. Walden Coal conducted <br />an additional woody plant density survey at the Bourg Strip Mine within the <br />grassland reference area. All areas of the pre-mine grassland vegetation type <br />had been previously disturbed. The information and data submitted to the <br />Division is acceptable. Walden Coal proposed a revegetation success standard <br />for woody plant density of 2,000 stems per acre in the response to this <br />stipulation. This level of replacement of woody plants is acceptable to the <br />Division and consistent with other mines in North Park.
