RE: Division Review of Responses to Stipulations for the Bourg Strip Permit
No. C-021-81
Dear Ms. James:
This letter will serve as a review of the responses suomitted by Walden Coal
for Stipulations 1 through 6 to the original Bourg permit and for Stipulations
1 and 2 for the Technical Revision No. 1 (incorporating the Northgate
Load-out) to the Bourg Strip permit.
Stipulation No. 1 required that Walden Coal Company provide a map and
discussion delineating those areas in which oxidized coal has been or will be
disposed and explain the method of disposal. Walden Coal nas inet the
requirements of this stipulation by providing this discussion and delineating
the areas. The requirements of this stipulation were satisfied in March of
1983.
Stipulation No. 2 required the permittee to demonstrate the suitability of
soil material to the north of the office and shop area. Walden Coal submitted
this information and satisfied the stipulation in April 1983.
Stipulation No. 3 required the permittee to provide the Division with adequate
baseline woody plant density information for the grassland vegetation type.
This stipulation also required the permittee to develop woody plant density
revegetation success criteria and have these approved by the Division prior to
being relieved of the obligations of the stipulation. Walden Coal conducted
an additional woody plant density survey at the Bourg Strip Mine within the
grassland reference area. All areas of the pre-mine grassland vegetation type
had been previously disturbed. The information and data submitted to the
Division is acceptable. Walden Coal proposed a revegetation success standard
for woody plant density of 2,000 stems per acre in the response to this
stipulation. This level of replacement of woody plants is acceptable to the
Division and consistent with other mines in North Park. Walden Coal is hereby
relieved of the requirements of Stipulation No. 3 by the Division.
