Long, <br />Division Director <br />The Division would like to take this opportunity to respond to the questions <br />raked in your June 22, 1992 letter. <br />a. Was the sediment pond capacity measured and certified by an engineer? <br />No. Paragraph 22C of the Compliance Agreement of April 22, 1992, called <br />for Harrison-Western to dredge the pond so it would contain the 10-year, <br />24-hour event. The Division is currently assessing compliance with this <br />requirement as a result of its inspection during the week of July 13, <br />1992. <br />b. Who is responsible for the reclamation of the denuded area adjacent to <br />the ne~.v diversion ditch? <br />Division staff understands that Harrison-Western Seeded and mulched the <br />areas associated with the diversion ditch twice. If the seeding does not <br />take after a year or two, the Division will perform augmented seeding in <br />conjunction with other reclamation activities at the site. <br />c. Is it permissible to not save topsoil? <br />Rule 4.06 is the performance standard for topsoil. It requires topsoil <br />to be salvaged and either re-distributed to achieve reclamation or <br />stockpiled (Rule 4.06.1(2)) <br />d. Was the diversion ditch engineered? <br />Engineering calculations were performed to assess the sizing of the <br />diversion ditch. <br />
