iii iuiiiiiiiiiiiii
999
STATE OF COLORADO
Roy Romer, Governor
r; .~
~ ~.
DEPARTMENT OFNATURAL RESOURCES
MINED LAND RECLAMATION DIVISION
FRED R. BANTA, Dlreetor
October 6, 1989
Mr, and Mrs. Robert W. Chandler
1205 Western Avenue
Trinidad, Colorado 81082
RE: Comment on Proposed Rimrock Strip Mine
Dear Mr, and Idrs. Chandler:
This is to acknowledge receipt of your letter dated September 16, 1989 in
regard to the proposed Rimrock Strip Mine. The Division is indeed in the
process of considering the application fora permit to conduct mining and
reclamation operations by the operator of this mine. There area number of
issues still to be resolved in regard to the proposed operation, and it is by
no means certain at this time that the application will be approved. If the
Division, however, does determine that the operation meets the requirements of
the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining
and proposes to approve the application, public announcements will be made in
the Trinidad newspaper, and a copy of the written Division's Findings in
regard to the application will be made available locally. You may be
satisfied at that time that the issues you have raised have been properly
addressed. If not, the public announcement of the decision initiates a 30 day
period during which anyone adversely impacted may so notify the Division and
request a formal hearing on the decision before the Colorado Mined Land
Reclamation Board. If such a request is made, the Division's decision is not
final unless affirmed by the Board following a formal public hearing.
The concerns that you have in regard to the proposed operation are certainly
understandable, but are perhaps more properly addressed at the local level.
Regardless of the Division's decision, the Rimrock"Mine cannot °p roceed-withaut---
having county approval. You should be aware, however, that some local
consideration has been made. A special use permit for the mine was issued by
the Board of Las Animas County Commissioners July 10, 1987.
If I may be of any further help in this matter, please contact me.
Sincerely,
~ /
~;UM~fvi (~~ N.Gw,
James C.
