Box 1487 <br />Montrose, CO 81402 <br />Vu h.i~dP IunC <br />D~vnnm Ilu r~ w. <br />RE: Letter. regarding Corey Gravel Pit 3 (Permit M-87-024) dated <br />May 18, 1996 <br />Dear Mr. Mathis: <br />In response to your letter, referenced above, the permit file for <br />the Corey Gravel Pit 3 does not indicate the permit for the <br />operation to have expired. The annual report and fee for 1995, <br />however, which would be expected on or before the April 17, 1996 <br />anniversary date for the permit is not in the file. Should these <br />not be received within the fairly near future, the Division might <br />take action to bring the matter before the Mined Land Reclamation <br />Board as a possible violation which, if so found by the Board, <br />could ultimately lead to revocation of the permit and forfeiture of <br />the reclamation bond. This has not, however, taken place and would <br />not unless the operator is completely unresponsive in regard to <br />providing the annual report and fee. <br />In regard to the required reclamation, I enclose copies of the <br />applicable parts of the approved permit application--as a courtesy. <br />Permit files, such as that for the Corey Pit, are maintained for <br />public use during normal working hours in the Division offices in <br />Denver and, to a limited extent, Durango. The Division, however, is <br />a permitting and enforcement agency with limited resources and <br />cannot provide extensive research efforts in regard to those permit <br />files without charge. <br />As for any progress reports on the reclamation of the Corey Pit, <br />such updates are required in the operator's annual reports. As <br />indicated earlier, the report for 1995 has not yet been received <br />but earlier annual reports indicate a total of 3 acres of mining <br />disturbance has been graded. <br />
