Long, <br />Division Director <br />V' ' <br />Today I spoke with Sara Tucker, assistant to C.H. Arbaugh, about the Apex <br />records. From our conversation, Sunland Coal a subsidiary of Capstan Coal <br />is considering reclaiming the Apex Mine. C.H. Arbaugh was in Colorado a <br />couple of weeks ago to look at the mine site and took the records back to <br />Indiana to make a copy of them. Sunland does not have their own copy. <br />Sara said that they are reviewing the reclamation plan and will probably <br />reclaim the site. This is contingent on a vote of the officers of Sunland. They <br />are looking at getting a contractor to do the work. <br />She said that after making a copy of the records they were mailed back to <br />Hovi sales. I called Hovi and a employee confirmed that the records arrived <br />later in the day after I had left. <br />Based on this information I decided not to issue an NOV. The mine did not <br />appear to be negligent in maintaining the records. I believe that the mine <br />was acting in good faith and had tried to get the records back to the <br />designated location. <br />I told Sara that the Division would like to be kept informed about any plans <br />to recl~rr~the site. <br />If you have any ideas or if you see any hornets nests that we may back into, <br />let me know. <br />
