Box E <br />Paonia, Colorado 81428 <br />Re: Review of Response to Stipulation No. 1 <br />Orchard Valley Mine - Our File No. C-038-81 <br />Dear Ms. Farnsworth: <br />The Division has reviewed the information submitted by C.W.Z. in response to <br />the requirements of Stipulation No. 1 attached to permit No. C-038-81. <br />This stipulation requires the applicant to "obtain a letter from the State <br />Historic Preservation Officer stating whether or not there are any places <br />located within the proposed permit area which are listed or eligible for <br />listing in the National Register of Historic Places". The material submitted <br />consists of a file search conducted by the SHPD to identify any place listed <br />or eligible for listing in the Register, and this information is sufficient <br />to satisfy the requirements of Stipulation No. 1. <br />The file search indicates that C.w.I.'s proposed mining operation is in compli- <br />ance with all Colorado regulations pertaining to cultural and historic resources, <br />as there are no places within the permit area which are currently listed in <br />the National Register of Historic Places. In regards to Federal regulations <br />which require information on places within the permit area that are eligible <br />for listing in the National Register, the file search indicates that two sites, <br />Nos. SDT00095A and SDT00124A, exist within the permit area (Section 7, R91W, <br />T13S) and may be eligible for listing, although more information is required. <br />C.W.I. should contact the OSM and the SHPO to discuss the current status of <br />these two sites and whether or not any relevant information can be provided <br />to assist in crompleting the eligibility determination. <br />If you have any questions, please do not hesitate to call. <br />Sincerely, <br />/~ nom/ l~ ' <br />Tom Gillis <br />Reclamation Specialist <br />TC/mt <br />
