Cattany <br />Division Director <br />Natural Resource Trustee <br />In September, the rules of the Colorado Mined Land Reclamation Board were revised. <br />Included within that revision was a new rule -Rule 4. ] 5.1(5) requiring every operator to <br />have a weed management plan in their permit. <br />The exact rule states that "each operator shall submit a weed management plan that <br />will become part of the permit requirements. Species to be considered shall be <br />noxious weeds as set forth in the permit. The plan shall also address invasion of <br />other weed species that seriously threaten the continued development of desired <br />vegetation. Weed control methods shall also be used whenever the inhabitation of <br />the disturbed area by weeds threatens further spread of weeds to nearby areas." <br />A letter was sent by the Division on 1 December 2005 requesting that operators add this <br />weed management plan to their permit by minor revision by 1 March 2006. To date, <br />Eastside Coal Company has not submitted a revision to the Division. Please respond <br />with a plan to be added to the revegetation section of the permit in compliance with Rule <br />4.15.1(5) above.
