FILE NO. M-2001-001, CONSIDERATION OF A 112 CONSTRUCTION <br />MATERIALS PERMIT APPLICATION OVER OBJECTIONS <br />OBJECTORS Carol Stepe and John E. Akin hereby request a copy of the <br />transcript of the "pre-hearing conference" in this matter held in Dolores, <br />Colorado on or about May 15, 2001: <br />The Mined Land Reclamation Board [MLRB] held a hearing on or about <br />May 15, 2001 in Dolores, Colorado which they labeled a "pre-hearing <br />conference." <br />2. Staff of the Division of Mining and Geology [DMG] recorded the hearing <br />which was presided over by a "pre-hearing conference officer." <br />3. Under the provisions of C.R.S. § 24-4-105(13) (2001) the MLRB and the <br />DMG (and the appointed "officer") were required to record the proceeding. <br />4. Under the provisions of C.R.S. § 24-4-105(13) (2001) the MLRB and the <br />DMG (and the appointed "officer") are required to provide a transcript of <br />the recorded proceedings upon the request or demand of one of the <br />parties. C.R.S. § 24-4-105(13) (2001) states in pertinent part: <br />When required, the ...hearing officer shall cause the <br />proceedings, or any portion thereof, to be transcribed, <br />the cost thereof to be paid by the agency when it <br />orders the transcription or by any party seekir_g to <br />reverse or modify an initial decision of the .. ,hearing <br />officer. Id. <br />5. The requesting parties will advance the cost of preparing the transcript <br />upon receiving a written notification of the cost of the transcript and the <br />details of how payment should be made. <br />
