Long <br />Divi>ion Dneaor <br />RE: Pattern of Violations and Issuance how Cause Order, <br />Basin Resources, Inc., The New Elk Mine, <br />Permit No. C-81-012 <br />I have reviewed your memorandum to me dated October 26, 1993, <br />regarding the Pattern of Violations at the New Elk Mine in Las <br />Animas County. I concur with the staff determination that a <br />Pattern of Violations has existed at the mine. <br />I concur that the sixteen Notices of Violation do not represent <br />isolated departures from lawful conduct, but rather a broad, <br />overall lack of concern with regulatory compliance by the <br />permittee. <br />I concur that these violations were caused by the unwarranted <br />failure of the permittee to comply with the requirements of the <br />Act, Rules, and permit conditions. <br />I therefore direct you to issue to Basin Resources, Inc., an <br />Order to Show Cause why New Elk Mine permit should not be <br />suspended or revoked. I find that no exceptional circumstances <br />exist that would provide a basis for deeming the issuance of such <br />an order as demonstrably unjust. <br />m:\oss\scm\mlong2.mmo <br />
