Long <br />Drvisiun Dveaor <br />RE: Beech Hill Quarry Pit, Permit No. /tM-81-107, Notice of Possible Violation for Failure to Post <br />Adequate Financial Warranty <br />Dear Mr. Vasquez, <br />On July 22, 1997, the Division of Minerals and Geology conducted an inspection of your operation and found <br />the following: that at this time the additional required band of $9,879.00 has not been submitted to the <br />Division of Minerals and Geology (DMG); and, alternatively, performance of reclamation work to bring the <br />reclamation liability under the currently posted bond has not been completed by the formerly imposed due <br />date of October l7, 1997. <br />We believe this is in violation of: C.R.S. 34-32.5-117(4)(b)(I), for failure to keep a fmancial warranty <br />adequate to complete reclamation of a permitted site. Therefore, we have reason to believe that a violation <br />exists to Permit Number M-81-007 and to the Law, and have scheduled this matter before the Mined Land <br />Reclamation Board. <br />A Formal Public Hearing will be held at the December 17-18, 1997 Board meeting, for consideration of <br />possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beginning at 9:00 a.m. or as soon thereafter as the matter can be considered. At that hearing you will have <br />the opportunity to be represen[ed and heard. It will be rei[erated that there is reason to believe that you are in <br />violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist order, assess a Civil Penalty in <br />the amount of $100.00 to $(000.00 for each day of violation, or order the permit be suspended, modified, or <br />revoked. In addition it may set the matter for consideration of forfeiture of the $I 1,421.00 financial warranty <br />at a subsequent hearing.
