Catlany <br />Division Director <br />Natural Resource Trustee <br />TO: Memo To File <br />FROM: Joe Dudash <br />RE: Bear No. 3 me, Permit No. C-1981-033, Bear Coal Company <br />Underground Mine Fire <br />Today, I talked by telephone with Bill Reitze, Supervisory Mining Engineer for the Ventilation Branch <br />of the Mine Safety and Health Administration (MSHA) (303-231-5576). I asked him if MSHA had any <br />jurisdiction over a mine fire in a reclaimed mine. I told him that the Beaz No, 3 Mine has been <br />reclaimed with portals sealed. There appears to be some kind of thermal event in the mine. <br />Bill told me that, once the mine portals have been sealed, the jurisdiction goes to the state program and <br />OSM. <br />I asked him if there was any documentation from MSHA concerning the sealing of the portals. Bill <br />said that he did not know of any documentation. MSHA only requires 25 feet of backfill material in the <br />portal.
