Your claim against the above referenced project was received on November 14, 1994. The
General Conditions of the Contract allow you 30 days from receipt of this letter to submit any
further oral and/or written evidence in support of your claim
In your letter you both filed a claim and requested a final written decision. The Colorado
Procurement rules, R-24-109-106-02(a) require that when a final decision is requested, I must
make that decision in twenty working days, (December 13, 1994). Had you simply submitted a
claim, as outlined under the General Conditions, I would have notified you of the 30-day time
period to submit further evidence, and directed you to request a final decision when you had
submitted all evidence.
Since you have done both in the same letter, I must proceed with the 20-day time frame and issue
a final decision by December 13, 1994, unless you notify me in writing by November 28, 1994 that
you waive the 20-day requirement for a final decision and that you require more time to submit
oral and/or written evidence in support of your claim.
If you decide not to waive the 20-day requirement for a final decision, in order to meet the
decision deadline, please plan to present any further written and/or oral evidence by December
2, 1994. Please call Maggie Van Cleef if you would like to schedule a meeting time to present
oral evidence.
The Colorado Procurement Code C.R.S. §§ 24-109-106; 24-109-107; 24-109-201 through -206 (1984
Replacement Volume and 1994 Supp.), and Rules R-24-109-106-O1 through -02; R-24-109-202-O1
through -03 and R-24-109-204 apply to this situation. Copies of the procurement code and rules
