Box 306 <br />Shiprock, N.M. 87420 <br />June 3, 1991 <br />Eleanor & I purchased the former "Hay Gulch Ranch" from Tony and <br />Barbara Sarver last May in 1990. In the time that we have owned the <br />new Oak Springs Ranch, as we will call it, we have found there to be a <br />problem with an existing pipe going:under the road by the "Old Peacock <br />Mine", and running into our property. <br />This pipe has caused drainage problems into our property where <br />sediments and tailings from the Peacock Mine; coal, rock, sand, & gravel <br />have drained into the main Hay Gulch Ditch filling up some spots so to <br />speak, and has plugged our main irrigation ditch which allows us to get <br />water to the west end of our property. <br />We have contacted the county office in Marvel, Colorado and we spoke <br />to a gentleman by the name of Ron Getty who referred us to the Mined Land <br />Reclamation Office as he believed the mine was turned over to them. Also <br />I spoke to Tony & Barbara Sarver who referred us to Dan Mathews of the <br />Mined Land Reclamation Division. Dan Mathews, I believe, got in touch <br />with someone who covered the Hay Gulch Area. One week ago today I <br />received a call from Denver from Harry Raney. <br />At this time you spoke to me about the current problems about tfie <br />existing structure and asked me to draw designs or take photographs of <br />this structure. I have taken photos and have enclosed them with this <br />letter so it will go on record concerning the drainage problems we are <br />currently facing and the plugged up ditch which allows water to flow to <br />the west end of our ranch. We have made a smaller ditch so we can still <br />use our share of water in the ditch and irrigate the west end of this land. <br />Hopefully you will be able to assist us as soon as possible with the <br />above stated obstacle.
