The runoff from this <br />area simply collects at the bottom. The area in questions is about 50 acres. AS per the approved <br />permit, the runoff water should have been draining to Pond 001. Obviously, Peabody did not reclaim <br />this area in an adequate manner. WFC acquired the property with an assumption that Peabody had <br />followed the reclamation plan. <br />DMG has now required that Westem Fuels-Colorado, A Limited Liability Company, provide proper <br />drainage from this area. Doing so will require survey, design and construction of an adequate <br />drainage channel. WFC will require that Peabody pay for the cost incurred by WFC in this regard. <br />If Peabody prefers to perform this task on its own, please let me know by June 21, 1993.
