Boz 1430 <br />Palisade, Colorado <br />Dear Mr. Reschke: <br />The Office of Surface Mining Reclamation and Enforcement (OSMRE) hoe <br />terminated, effective immediately, Federal permit CO-0020, issued on January <br />20, 1983, for Powderhorn Coel Company's Roadside and Cameo mine. The Federal <br />permit was terminated in accordance with OSMRE's Directive on the Termination <br />of Federal Permits because the State has a cooperative agreement that <br />delegates the permitting responsibilities on Federal lands to the State, and <br />Colorado Mined Land Reclamation Division (NERD) hoe issued State permit <br />C-81-041 for the Roadside and Cameo mine in accordance with the Colorado State <br />program and cooperative agreement. <br />I have enclosed the memorandum terminating the Federal permit. Attached to <br />the memorandum are the applicable standard and special conditions of approval <br />of the Roadside and Cameo mine mining plan approved by the Assistant Secretary <br />on January 17, 1983, for Federal leases C-01538, C-078049, C-020740, C-02499. <br />These conditions were previously incorporated in the Federal permit. <br />Notxithstanding the termination of the Federal permit, these conditions remain <br />in full force and effect. <br />Colorado MLRD is now the regulatory authority for surface coal mining and <br />reclamation operations on Federal lands at the Roadside and Cameo mine under <br />the Colorado State permit C-81-041, the Colorado State program, and the <br />cooperative agreement. Mining operations on Federal leases C-01538, C-078049, <br />C-020740, C-02499 must be conducted in accordance xith the approved mining <br />plan including the standard and special conditions, the leases, the Mineral <br />Leasing Act of 1920, as amended, and its implementing regulations, ae well as <br />the State permit. <br /> <br />IloV ^ ~, to^B <br />... <br />~Ili~r:; f_n„_ <br />fiECLHt~iA;'I.~iV >i`ai:'.UIV <br />
