The work is <br />proposed to begin in early May and continue until its completion. <br />We informed Mr. Barb that because the potential exists for raptors <br />of high federal interest nesting in the area (golden eagles, prairie <br />falcons, Cooper's hawk) that we could not approve access to this <br />area until after July 15, unless a raptor survey is flown which <br />indicates there are no nesting raptors in the area. <br />If Powderhorn Coal determines early access is necessary, then our <br />Grand Junction office would like to be involved in the pre- <br />exploration survey. If raptor nests are located, we would establish <br />a buffer zone to that specific area requiring no disturbance within <br />the buffer zone until the birds have fledged from the nest. Time of <br />fledging may be determined by Powderhorn based upon ground monitor- <br />ing of the nests. In those areas where there are no known nesting <br />raptors, drilling could commence immediately following the survey. <br />We appreciate Powderhorn Coal Company's early coordination on this <br />project.
