We entered into an agreement with Wyoming Fuel in <br />1988 to mine under this property with written assurance that <br />subsidence monitoring would be done to protect this <br />structure, Our home is now severely damaged and no <br />monitoring or any attempt to prevent damage was ever done. <br />Enclosed please find reports from; <br />Las Animas County Building Inspector <br />Colorado Real Estate Inspection Services, Inc. <br />We note that on June 22, 1992, NOV C-92-010 was issued <br />for failure to submit to the Division the results of the <br />subsidence monitoring program. This company obviously has a <br />policy of deliberately disregarding the Colorado Law and <br />Rules governing mining. <br />We also note that thirteen stipulations appeared in the <br />Findings Document of January, 1, 1989 and seven stipulations <br />were imposed between January and July of 1989 - the only <br />stipulation not satisfied or incorporated as of December, <br />1992 - THREE YEARS LATER was Stipulation No. twenty-eight. <br />Why was the mine allowed to continue to disregard this <br />directive? <br />Earlier we had Mr. Dudash inspect a blower shaft that <br />is obviously emitting toxic gas as the vegetation is dead or <br />dying around the shaft and we are not getting a response <br />
