I have
highlighted in yellow the property of interest to you based on the legal description as I
understood it; NW/4 section 14, T33S R67W. As you can see, highlighted in blue, the
currently approved mining permit boundary is located in section 15 and furthermore, based
on the currently approved mine plan, only a very small portion of section 15 would be
affected by mining related impacts.
Approved exploration activity outside of the permit boundary was mainly located in sections
5, 6, 7, and 8 of T33S R67W, as well as in T33S R68W. The Division is not aware of any
approved exploration activity in section 14, T33S R67W.
At this time, the Golden Eagle mine is closed, the portals have been sealed, and the mine
equipment will be auctioned during the first week of August. The New Elk mine facility,
located further west of Golden Eagle, may be transferred to another company in association
with an informally proposed mine which will be located south and east of Weston. While
this proposed mine will not affect land in section 14 directly, nor any land north of Highway
14, various localized impacts such as traffic, dust, noise, etc. are possible. Generally, these
issues are regulated by the county through public input and zoning regulations.
However, the coal mining laws are structured to include public comment as a key element
of coal mine permit approval. Public notices of filings and decisions, public availability of
mine records, and citizen complaint inspections are only a few of the mechanisms to ensure
